The short version

  • Organisations discovering non-conforming product must immediately stop all certified sales until written certification body verification is granted.
  • Notification to the certification body must occur within two calendar days of detecting any non-conforming seafood product.
  • Affected commercial customers must be notified in writing within four calendar days if non-conforming product was dispatched as certified.
  • Self-reporting non-conforming product and executing standard procedures protects organisations from automatic certification suspension under scheme rules.

Regulatory framework and non-conforming product rationale

In seafood supply chains, non-conforming product represents a direct threat to the integrity of certified claims. Quality managers, compliance leads, and internal auditors must understand that handling non-conforming seafood requires immediate, mandatory action to prevent unverified product from reaching the market. Under the Marine Stewardship Council Chain of Custody Standard, non-conforming product is defined as any product identified as certified or labelled with MSC or ASC trademarks that cannot be proven to originate from a certified source.

This regulatory framework affects processors, wholesalers, traders, and group certificate entities handling certified seafood. While accidental mixing or documentation gaps can occur, failing to execute prescribed quarantine and notification procedures can lead to immediate certificate suspension. Understanding the strict timelines for certification body notification, customer communication, and corrective action prevents systemic audit failures while safeguarding consumer trust across global supply chains.

Immediate operational obligations and customer notification windows

When an organisation identifies a non-conforming product discrepancy, Clause 5.4.1 of the MSC Chain of Custody Standard: Default Version and Group Version dictates a mandatory four-step response sequence. First, under Clause 5.4.1(a), the organisation must immediately cease selling the affected product as certified. Certified sales cannot resume until the certification body verifies the product's certified status in writing.

Second, under Clause 5.4.1(b), the organisation must notify its certification body in writing or by email within two calendar days of detecting the issue. This notification must include all relevant origin documentation and batch data required by the auditor. Third, under Clause 5.4.1(c) and Clause 5.4.1(d), the organisation must investigate the root cause, implement preventive controls, and re-label or repack any unverified stock as non-certified product.

Fourth, under Clause 5.4.1(e), if non-conforming product has already been sold or shipped as certified, the organisation must notify all affected commercial customers in writing within four calendar days of detection. Guidance 5.4.1(e) notes that final consumers do not need to be notified. Under Clause 5.4.1(e)(i) and Clause 5.4.1(e)(ii), the customer notification must detail the circumstances, specify affected batch numbers, and be retained as a record for at least three years.

Self-reporting protections and certification body verification protocols

Under general certification rules, selling uncertified product as certified constitutes a severe breach of supply chain integrity. Under Clause 7.4.10(b) of the MSC General Certification Requirements v2.6, selling non-certified product as certified normally triggers automatic certificate suspension. However, Clause 7.4.14.2 introduces a vital protection for certificate holders who proactively manage errors through transparent internal controls.

Specifically, Clause 7.4.14.2 provides that if a client self-identifies and reports an issue of mislabelling or non-conforming product, the certification body shall not suspend the certificate, provided the client fully executes the non-conforming product procedure under Clause 5.4.1. Under Clause 7.4.14.2(a), the certification body must verify the effectiveness of the client's corrective actions within thirty days of the initial notification. If the organisation fails to follow Clause 5.4.1 requirements or if corrective actions prove ineffective, Clause 7.4.14.3 mandates immediate certificate suspension.

Guidance 5.4 also clarifies an important practical exclusion: if a certified supplier delivers non-certified product, but the receiving organisation identifies the error upon receipt and returns the delivery immediately, the formal non-conforming product procedure does not apply. In such cases, standard goods-receiving inspection records and rejection logs are sufficient to demonstrate control.

What to do now

  • Integrate an immediate quarantine trigger into the inventory management system upon detection of unverified seafood batches.
  • Draft standardised notification templates for reporting non-conforming product incidents to the certification body within two calendar days under Clause 5.4.1(b).
  • Establish customer notification protocols to transmit affected batch details to commercial buyers within four calendar days under Clause 5.4.1(e).
  • Maintain comprehensive records of all non-conforming product investigations, root cause analyses, and customer notifications for at least three years under Clause 5.1.3.
  • Train receiving staff to inspect incoming supplier documentation immediately so misdelivered non-certified stock can be rejected at receipt without triggering Clause 5.4.1.
